Case: Sub Contractor Vs Main Contractor
The sub contractor was appointed under DOM 1 to carry out M&E services for the development of luxury flats.

Problems occurred from the beginning and the sub contractor performed poorly. This was further exaggerated by the problems of the main contractor.

Relationships deteriorated between the parties and the dispute had been referred to arbitration by the time of our appointment.  We acted as expert witness for the quantum of variations under the direct instruction of the arbitrator.  This was due to a significant variance against respective values.

We produced a detailed report and subsequently were instructed to meet with the main contractor’s equivalent expert.

A joint report was then produced which was accepted by the arbitrator. This confirmed the true extent and value of the variation account.

Lesson – never under-estimate the variation account, its often the easiest way to proper reimbursement.
